yes, the case does not cover the part of the fabric grill (sides) for the volume. You can still tap the sides to adjust volume.

Don't you think Google has enough $ in R&D to have determined the home mini is intended to be heard best sitting flat?

Weirdly all stands stand it upright and I feel that it does hear you better than when just laying flat - you can also see the lights when it is upright to know that it has heard you.
