Do you have to have the commode on it to use it? I am wondering if I can put this over my toilet to hoover over it.

I would suggest that you do not hoover over the toilet. But if you want to use this item without the bucket (which I think is what you meant) yes, there is even a splash guard that helps ensure that stuff gets all the way into the toilet from the seat.

How many pounds is it approved for?

It's only good for an under 175 pound person IMO. It will HOLD up to 350 pounds BUT the rails are not wide, cannot be removed or lowered so The bigger person would not be able to wipe without standing up! There is no room to open your legs. If you're large you have to sit with legs closed and most people don't use a toilet that way. I would only reccomend for average size person. Ours is useless for person we bought it for.

What is the minimum height this commode can achieve if one adjusts the legs to the very first setting? I am planing to use this for a short person.

15 3/4" That's floor to top surface of commode seat. I am 4'7'' and have mine adjusted to the lowest position.

Will a 5 gallon bucket go underneath it? Will there be a large gap between seat and bucket? How much of a gap?

I just measured the height of a 5 gallon driveway sealer bucket. It was 14.5 inches high. This particular commode has various height possibilities, the lowest being 14.5 inches. Seems like you're fine.
